Addendum “A” to Contract
Insurance Requirements

 

Certificate of Liability Insurance Sample

  1. Prior to the commencement of any operations by or on behalf of the Hubert Construction, LLC (Contractor) relating to the project, and with respect to any and all such operations, the subcontractor/supplier contractor shall procure, maintain at its expense, and provide evidence of insurance coverage in form and substance acceptable to Contractor.
    • Insurance shall be procured from an insurance company rated no less than “A-VII” per AM Best Insurance Ratings.
    • If the commercial general liability (CGL) insurance contains a general aggregate limit, such limit shall apply separately to each project.
    • The certificate shall name Contractor, Owner, and other parties designated by the Contractor and/or Owner as “Additional Insured” under the policies required. In addition, attached to each certificate of insurance shall be a copy of the Additional Insured Endorsement that is part of the Subcontractor’s CGL policy.
    • The certificate shall state that all policies are “primary and non-contributory” with any coverage Contractor and/or Owner may maintain in its own name and on its own behalf.
    • Policy requirements that not less than 30 days notice of cancellation or non-renewal be provided to Contractor.
    • Subcontractor shall maintain CGL coverage for itself and each additional insured for the duration of the project and maintain completed operations coverage for itself and each additional insured for at least 3 years after completion of the work.
  2. Evidence of insurance shall be provided in the form of a Certificate of Insurance with minimums shown on the attached example and shall meet the following minimum specifications:
    • Workers Compensation Insurance must be provided in accordance with the laws of the state or state in which work is performed, with employer’s liability limits described in the attached certificate of insurance.
    • Commercial General Liability (CGL) Insurance must be provided with limits described in the attached certificate of insurance. The Additional Insured Form Number/s must be displayed on the certificate.
    • Comprehensive Automobile Liability for bodily injury and property damage for all vehicles owned, non-owned, and hired and used by the subcontractor/supplier on the project and must be provided with limits described in the attached certificate of insurance.
    • Excess/Umbrella: With following form coverage as that provided by CGL policies with limits described in the attached certificate of insurance.
    • Pollution Liability Insurance: The following trades are to have a pollution liability insurance policy with the limits described in the attached certificate of insurance:
      Painting - Asphalt - Paving - Roofing - Carpet - HVAC - Masonry - Electrical
    • The Pollution Liability Policy must have a Mold/ Fungi Endorsement indicating that mold/fungi coverage is afforded under the policy and if this is provided by sub-limits, the sub-limit must be shown. If a deductible applies, this must also be shown.

    • Design/Build Liability Insurance: Any subcontractor/supplier who performs design services by a professional engineer to complete the work shall provide liability insurance with the limits described in the attached certificate of insurance. This includes:
      Structural steel systems Fire protection systems Structural Metal Stud Systems

    The terms, parties covered, and amounts of coverage listed above are to be considered minimum coverages subject to requirements of the contract documents.

     

  3. Waiver of Subrogation: Subcontractor waives all rights against Contractor, Owner and Architect and their agents, officers, directors and employees for recovery of damages to the extent these damages are covered by the insurance maintained per requirements stated above.
